New Studies in Education: The Judicial Power of the New York State Commissioner of Education- Its Growth and Present Status

CAN a left-handed child be legally compelled to write with his right hand?1 Are a teacher's activities as a citizen, e.g., membership in the Communist party or picketing for a political principle, inconsistent with her role as teacher? Can the principal of a school legally insist on the right to supervise a school publication? Can a board of education be compelled to give the use of a school auditorium for the discussion of "old-fashioned free speech"? Can a board of education ignore the recommendations of a superintendent of schools as to the appointment of teachers? Can a board of education dismiss a teacher because of marriage or maternity? These and numerous other issues sketchily indicate the discords in New York State's educational symphony which the Commissioner of Education is constantly being called upon to reduce to harmony. To bring this judicial aspect of state educational administration more to public attention and to digest the thousands of decisions in New York State for popular use has been the object of the present study.
