Mr. Schnapper examines the use of copyright by high public officials to place public information under their private control. Such practices can deprive the public of access to materials which the public has financed and which properly belong to the people. The US Copyright Act clearly aims to prevent government agencies and officials from restricting information that rightfully belongs in the public domain. Section 8 states, "No copyright shall subsist in any publication of the United States Government or any reprint, in whole or in part thereof." The official Code of Ethics for Government Service emphasizes that the government employee must never "use any information coming to him confidentially in the performance of governmental duties as a means of making private profit." The question of governmental copyright is complex, and not all copyright is an abuse, as the author is careful to point out. But corrosive precedents are being established by officials...
