Legal Bases of Individualization

This chapter attempts to clarify how recent applications of legal principles and changes in law relate to individualization in schools. In order to provide perspective, some general principles will be presented first, sketching the overall relationships of public schools to various levels of government and therefore to different sources of law. Second, the chapter will indicate the difficulties courts encounter in applying legal principles while attempting to stay out of matters of educational policy. And, third, it will indicate the important but limited role that courts and the law play with regard to individualization in schools.
